En esta entrevista se resolvieron las interrogantes formuladas y orientadas a la preservación de la lengua castellana en Hispanoamérica. En principio, se abordaron tres temas fundamentales derivados de esta propuesta: la escritura, la investigación y la publicidad. Con el primer tópico, se discernió la función de las normativas, los diccionarios y los manuales elaborados por la Real Academia Española. Su intervención es enjundiosa, ya que direcciona al lector y académico al perfeccionamiento de su lenguaje, con la finalidad de que no (...) reincida en errores gramaticales. El segundo rubro abarca la investigación. Esta fue destacada porque facilita la interacción de los hablantes de la lengua castellana con las metodologías que se instauran para configurar un lenguaje totémico. Además, se asume que la única manera de difundir y contribuir a ese conocimiento sería por medio de las publicaciones científicas. La tercera variante consiste en cómo se inserta esta inquietud en torno a la lengua castellana en los ámbitos publicitarios. Esto es neurálgico por su audiencia limitada y el desinterés de respaldo por los Gobiernos. Frente a ello, consideré que el Dr. Ignacio Bosque Muñoz era la persona idónea para confrontar esta realidad sobre el castellano. Su rol importante en la RAE y la Asociación de Academias de la Lengua Española (ASALE) lo amerita, así como sus publicaciones orientadas al estudio del idioma con enfoques gramaticales. Con su interacción, la volición de este trabajo se evidenciará con la explicación del panorama vigente de la lengua y su preservación, como cuando uno desea comprender el Quijote, entender las contribuciones gramaticales y lexicales de la RAE y la ASALE o cuestionar la proliferación del idioma desde los medios de comunicación. La auscultación de esas oscilaciones será el aporte de esta entrevista. (shrink)

María José Rincón González nació en Sevilla (España) y reside en República Dominicana desde 1992. Es miembro de número de la Academia Dominicana de la Lengua (ADL) desde el 2011 y directora del Instituto Guzmán Ariza de Lexicografía. Asimismo, es miembro correspondiente de la Real Academia Española (RAE) y miembro del consejo asesor de Fundéu Guzmán Ariza. Con respecto a su formación superior, es doctora en Filología por la Universidad Nacional de Educación a Distancia (UNED) y máster en Lexicografía por (...) la Universidad de Sevilla y la UNED. Ha participado en congresos internacionales y ha contribuido en las ediciones de diccionarios del idioma español. Esta entrevista realizada al vicedirector de la Real Academia Española, José Manuel Sánchez Ron, busca resolver las inquietudes que se formulan a partir de las posibilidades de hallar una conjunción metodológica entre la Literatura y la Física. Para ello, se toma en cuenta la organización especializada de la RAE, que se encarga de la difusión y la preservación del buen uso del lenguaje y la creación literaria. El discurso, junto con las personalidades que se dedican a desarrollarlo, cumplen también un (...) rol importante para ello, ya que sirven como ejes para construir un lenguaje apropiado del castellano. Para terminar, este intercambio de conocimientos será de utilidad para desentrañar cómo se desenvuelve esta dicotomía de disciplinas en otros ámbitos, como el universitario. (shrink)

This paper is divided in four parts. In the first part we introduce the method of internal critique of philosophical theories by examination of their external consistency with scientific theories. In the second part two metaphysical and one epistemological postulate of Wittgenstein's Tractatus are made explicit and formally expressed. In the third part we examine whether Tractarian metaphysical and epistemological postulates (the independence of simple states of affairs, the unique mode of their composition, possibility of complete empirical knowledge) are externally (...) consistent with the theory of quantum mechanics. The result of the inquiry is negative: Tractarian postulates ought to be be revised. Relying on the result we approach the question of the empirical character of logic in the fourth part. The description of theoretical transformations of the notion of disjunction, in its ontological, epistemological, and logical sense, is a common element of in all parts of the text. The conjecture on the existence of different types of disjunctive connectives in the language of quantum mechanics concludes the paper. (shrink)

People generally accept that there is causation by omission—that the omission of some events cause some related events. But this acceptance elicits the selection problem, or the difficulty of explaining the selection of a particular omissive cause or class of causes from the causal conditions. Some theorists contend that dependence theories of causation cannot resolve this problem. In this paper, we argue that the appeal to norms adequately resolves the selection problem for dependence theories, and we provide novel experimental evidence (...) for it. (shrink)

This chapter describes how philosophical theorizing about justice can be connected with empirical research in the social sciences. We begin by drawing on some received distinctions between ideal and non-ideal approaches to theorizing justice along several different dimensions, showing how non-ideal approaches are needed to address normative aspects of real-world problems and to provide practical guidance. We argue that there are advantages to a transitional approach to justice focusing on manifest injustices, including the fact that it enables us to set (...) aside some reasonable disagreements about justice. The ‘bottom-up’ approach we advocate, for which we borrow Wolff’s term ‘real-world political philosophy’, is an empirically-informed normative analysis that attends to specific, identifiable injustices, and thus is partial, though not isolationist. We illustrate our approach by considering how different models of the nature of disability suggest different kinds of remedy for injustices faced by persons living with disabilities. We reflect on the nature and significance of vulnerabilities, and we assess the role of public opinion in normative theorizing, suggesting a particular significance for the opinions and experiences of marginalized groups. We finally reflect on the relevance of European legal and institutional frameworks for theorizing justice in Europe. (shrink)

Past research has identified a number of asymmetries based on moral judgments. Beliefs about what a person values, whether a person is happy, whether a person has shown weakness of will, and whether a person deserves praise or blame seem to depend critically on whether participants themselves find the agent's behavior to be morally good or bad. To date, however, the origins of these asymmetries remain unknown. The present studies examine whether beliefs about an agent's “true self” explain these observed (...) asymmetries based on moral judgment. Using the identical materials from previous studies in this area, a series of five experiments indicate that people show a general tendency to conclude that deep inside every individual there is a “true self” calling him or her to behave in ways that are morally virtuous. In turn, this belief causes people to hold different intuitions about what the agent values, whether the agent is happy, whether he or she has shown weakness of will, and whether he or she deserves praise or blame. These results not only help to answer important questions about how people attribute various mental states to others; they also contribute to important theoretical debates regarding how moral values may shape our beliefs about phenomena that, on the surface, appear to be decidedly non-moral in nature. My dissertation develops a defense of a right to self-defense against the state. I set aside anarchist theories and grant for the sake of argument that the state has legitimate political authority. My goal is to convince non-anarchists that the right to self-defense extends to individuals against the state and the state’s agents. I argue that the right to self-defense is a fundamental, negative, claim right. The right to self-defense has these characteristics: (1) it is fundamental, meaning that it is (...) not derivative of any other right—it doesn’t appeal to any other right for its justification (2) it is negative, meaning that it simply requires others to refrain from certain action, and (3) it is a claim right, rather than a permission right, which means that it logically entails correlative duties on others. I also challenge some basic tenets of the orthodox account of justified defensive force, including the imminence, necessity, and proportionality conditions. My argument is a controversial one; many will resist the idea that an individual could be justified in self-defense against the state for a variety of reasons, ranging from thinking the idea is absurd or dangerous, to thinking that even if it is morally permissible, it is impractical. I aim to rebut these objections and to provide strong moral reasons to show why individuals do in fact have this right. -/- This research explores the relationship between one of our most basic rights—the right to self-defense—with our most basic political relationship—the relationship between the individual and the state. Part of my aim is to convince non-anarchist readers of philosophical claims that are usually only supported by anarchists. The reason this is important, beyond being academically interesting, is that if I am successful, it could allow a great majority of individuals to rethink their relationship with the state; not just at a basic level, but also in other applied areas such as gun rights, drug laws, and issues surrounding punishment and imprisonment. Multivariate pattern analysis, or MVPA, has become one of the most popular analytic methods in cognitive neuroscience. Since its inception, MVPA has been heralded as offering much more than regular univariate analyses, for—we are told—it not only can tell us which brain regions are engaged while processing particular stimuli, but also which patterns of neural activity represent the categories the stimuli are selected from. We disagree, and in the current paper we offer four conceptual challenges to the use of MVPA (...) to make claims about neural representation. Este trabalho apresenta algumas considerações a respeito da Base Nacional Comum Curricular (BNCC), no referente às questões ligadas ao ensino da língua portuguesa no Brasil, à territorialidade e ao pertencimento racial, processos históricos, que envolvem, no campo da educação, a formação docente e a construção da cidadania dos educandos e das educandas nestes tempos de reafirmação do Estado democrático de direito e da vaga decolonial. Portanto, trata-se de uma abordagem política em termos do pensamento de Paulo Freire, patrono da educação (...) brasileira, que considerava político o ato de educar (FREIRE, 1980; 1983; 1989; 1996). É com base nesta perspectiva que a BNCC será abordada, mas sob o aporte teórico da análise pragmática do discurso, tributária da análise discursivo-desconstrutiva (cf. ARAÚJO, 2020). (shrink)

In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. The paper offers a running commentary on ps-Archytas’ On Intellect and Sense Perception (composed ca. 80 BCE), with the aim to provide a clear description of Hellenistic/post-Hellenistic Pythagorean epistemology. Through an analysis of the process of knowledge and of the faculties that this involves, ps-Archytas presents an original epistemological theory which, although grounded in Aristotelian and Platonic theories, results in a peculiar Pythagorean criteriology that accounts for the acquisition and production of knowledge, as well as for the specific competences of (...) each cognitive faculty. In a situation of peer disagreement, peers are usually assumed to share the same evidence. However they might not share the same evidence for the epistemic system used to process the evidence. This synchronic complication of the peer disagreement debate suggested by Goldman (In Feldman R, Warfield T (eds) (2010) Disagreement. Oxford University Press, Oxford, pp 187–215) is elaborated diachronically by use of a simulation. The Hegselmann–Krause model is extended to multiple epistemic systems and used to investigate the role of (...) consensus and difference splitting in peer disagreement. I find that the very possibility of multiple epistemic systems downgrades the epistemic value of consensus and makes difference splitting a suboptimal strategy. (shrink)

Singularities in general relativity and quantum field theory are often taken not only to motivate the search for a more-fundamental theory (quantum gravity, QG), but also to characterise this new theory and shape expectations of what it is to achieve. Here, we first evaluate how particular types of singularities may suggest an incompleteness of current theories. We then classify four different 'attitudes' towards singularities in the search for QG, and show, through examples in the physics literature, that these lead to (...) different scenarios for the new theory. Two of the attitudes prompt singularity resolution, but only one suggests the need for a theory of QG. Rather than evaluate the different attitudes, we close with some suggestions of factors that influence the choice between them. (shrink)

In this essay we will argue for the following theses: 1- know-how is not a form of practical knowledge devoid of propositional sense; 2- the relationship between each perception and the body itself is metaphysically contingent (organisms and bodies can vary, as can even the spaces they occupy in the same experience vary), 3- it is up to the brain to configure or to shape a physical body (Körper) into a living body (Leib) and not the other way around; 4- (...) phenomenal externalism of enactivist nature, even in its mild form, is empirically implausible: the correlation between the conscious character of sensory experience with spatiotemporal neuronal patterns is much more systematic and regular than with anything outside the brain. But in its radical form is entirely implausible and contra-intuitive: phenomenal duplicates are not necessarily duplicates of agency; in short, 5-we are our own brain that has a body, avatars, and artifacts, properly configured, and molded by the brain, and not a body that has a brain among other essential organs. In this paper the system IL for relative interpretability is studied.

Is behavioral integration (i.e., which occurs when a subjects assertion that p matches her non-verbal behavior) a necessary feature of belief in folk psychology? Our data from nearly 6,000 people across twenty-six samples, spanning twenty-two countries suggests that it is not. Given the surprising cross-cultural robustness of our findings, we suggest that the types of evidence for the ascription of a belief are, at least in some circumstances, lexicographically ordered: assertions are first taken into account, and when an agent sincerely (...) asserts that p, non-linguistic behavioral evidence is disregarded. In light of this, we take ourselves to have discovered a universal principle governing the ascription of beliefs in folk psychology. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Abstract: The Pull Bayesian Significance Test (FBST) for precise hy- potheses is applied to a Multivariate Normal Structure (MNS) model. In the FBST we compute the evidence against the precise hypothesis. This evi- dence is the probability of the Highest Relative Surprise Set (HRSS) tangent to the sub-manifold (of the parameter space) that defines the null hypothesis. The MNS model we present appears when testing equivalence conditions for genetic expression measurements, using micro-array technology.

Contemporary debates about scientific institutions and practice feature many proposed reforms. Most of these require increased efforts from scientists. But how do scientists’ incentives for effort interact? How can scientific institutions encourage scientists to invest effort in research? We explore these questions using a game-theoretic model of publication markets. We employ a base game between authors and reviewers, before assessing some of its tendencies by means of analysis and simulations. We compare how the effort expenditures of these groups interact in (...) our model under a variety of settings, such as double-blind and open review systems. We make a number of findings, including that open review can increase the effort of authors in a range of circumstances and that these effects can manifest in a policy-relevant period of time. However, we find that open review’s impact on authors’ efforts is sensitive to the strength of several other influences. (shrink)

The recent publications reported in 2022 reveal the possibility of obtaining mouse embryos without the need for egg or sperm. These ‘artificial embryos’ can recapitulate some stages of development ex utero – from neurulation to organogenesis – without implantation. Synthetic mouse embryos might serve as a valuable model to gain further insights into early developmental stages. Indeed, it is expected for these models to be replicated by employing human cells. This promising research raises ethical issues and expands the horizon of (...) ethics in regard to the development of the human embryo. In this paper, I explore and examine different ways in which affectivity is related to perception within ecological psychology. I assess whether some of those ways compromise the realist and direct aspects of traditional ecological perception. I sustain that they don’t. Affectivity, at least in some cases, turns the perception of fine-grained affordances possible. For an engaged perceiver, affectivity is not optional.

We are addressing this letter to the editors of Philosophical Psychology after reading an article they decided to publish in the recent vol. 33, issue 1. The article is by Nathan Cofnas and is entitled “Research on group differences in intelligence: A defense of free inquiry” (2020). The purpose of our letter is not to invite Cofnas’s contribution into a broader dialogue, but to respectfully voice our concerns about the decision to publish the manuscript, which, in our opinion, fails to (...) meet a range of academic quality standards usually expected of academic publications. In this paper, I argue that the ecological approach to perception provides resources to overcome the causal argument against disjunctivism. According to the causal argument, since the brain states that proximally cause the perceptual experience and the corresponding hallucinatory one can be of the same type, there would be no good reason to reject that the perceptual experience and the corresponding hallucinatory experience have fundamentally the same nature. Disjunctivism concerning the nature of the experience would then be false. I identify (...) three assumptions that support the causal argument: the indistinguishability assumption, the linearity assumption, and the duplication assumption. According to the ecological approach to disjunctivism, these assumptions should be rejected, opening up room for a version of disjunctivism that I call 'Ecological Disjunctivism'. Perceptual episodes are extended over time and are supervenient to the organism-environment system. They can be distinguished from the 'corresponding' hallucinations because the former results from a controlled process of attunement to the environment, whereas hallucinations are passive and insensible to the exploratory activities of the perceptual system. Finally, ecological disjunctivism, since it is immune to the causal argument, is more advantageous than negative and positive disjunctivism. (shrink)

This paper discusses the possibility of an absolute vacuum - a space without any substance. The motivation of this study is the contrast between most philosophers, up to Descartes, who stated that a vacuum was impossible, and the 17th century change of outlook, when the possibility and effective existence of the vacuum was accepted after the experiments of Torricelli and Pascal. This article attempts to show that, contrary to the received opinion, the acceptance of an ether is preferable to the (...) acceptance of a vacuum for several reasons. First: it is impossible to provide an empirical proof of the non-existence of the ether; second, an absolute vacuum is unthinkable; third, the ether concept is useful for the understanding of physical phaenomena; and fourth, the hypothesis of an ether in apparently void spaces is useful for the future development of science. The paper also endeavours to show that no recent advance of science changed those conclusions and that no future development can change them. (shrink)

In this paper art history and visual studies, the disciplines that study visual culture, are presented as a field whose conjectural paradigm can be used to understand the epistemic problems associated with abduction. In order to do so, significant statements, concepts and arguments from the work of several specialists in this field have been highlighted. Their analysis shows the fruitfulness and potential for understanding the study of visual culture as a field that is interwoven with the assumptions of abductive cognition.

In this paper, I interview Francesca De Vecchi (Full Professor of Theoretical Philosophy in Vita-Salute San Raffaele University) about her qualitative ontology and its social and normative implications. If at the foundation of our lifeworld there are significantly qualitative experiences, phenomenology can investigate the most important contemporary issues, such as gender disparity, socio-virtuality depersonalizations and political urgencies.

This article examines whether people share the Gettier intuition (viz. that someone who has a true justified belief that p may nonetheless fail to know that p) in 24 sites, located in 23 countries (counting Hong-Kong as a distinct country) and across 17 languages. We also consider the possible influence of gender and personality on this intuition with a very large sample size. Finally, we examine whether the Gettier intuition varies across people as a function of their disposition to engage (...) in “reflective” thinking. (shrink)

O anseio deste artigo acadêmico é introduzir os conceitos gerais da teoria de sistemas de Niklas Luhmann. Para atingir seus objetivos, esta teoria é hermética e filosófica, com uma ampla gama de definições e busca apresentar um conjunto de conceitos que proporcionem um suporte adequado para a sociedade como um todo. Luhmann abordou a questão da complexidade em vários estudos e desenvolveu uma metodologia baseada em uma noção de sistemas autopoiéticos, funcionalmente fechados e distintos. A observação de segunda ordem é (...) um dos conceitos centrais da teoria de sistemas de Luhmann, assim como a comunicação é elemento importante na formação dos sistemas sociais e na sua distinção de outros sistemas existentes. RESUMO A inseminação artificial (IA) é a biotecnologia mais empregada com vantagens superiores em relação a utilização da monta natural, cuja eficácia se dá na larga escala de reprodução entre os bovinos. Associando essa biotécnica com hormônios pode-se estabelecer manipulações do sistema reprodutivo da fêmea, levando a manejos de inúmeras cabeças de gado para inseminar a um tempo fixo. Portanto, foram realizados 5 protocolos de IATF, tendo 2 categorias de animais: nulíparas e multíparas. No protocolo 1 foram submetidas 81 multíparas, (...) resultando em 47 animais prenhes; No protocolo 2 foram protocoladas 103 animais multíparas, no qual resultou em 51 prenhes; já o protocolo 5 foram submetidas 77 animais multíparas, no qual resultou em 36 animais prenhes. Cada serviço realizado foi matematicamente calculado, sendo o ponto de partida o escore corporal, bem estar animal e a técnica bem exercida. Desta forma obteve bons resultados na (IATF) , no qual destaca-se o percentual : o protocolo 1 obteve 58,02%, o protocolo 2 obteve 49,51% na taxa de prenhez, No protocolo 3 obteve 55,67% na taxa de prenhez, o protocolo 4 obteve 53,33% de prenhes, já o protocolo 5 resultou em 46,75% de prenhez. O uso das biotecnologias da reprodução, realizadas em bovinos de corte, obteve resultado dentro do descrito pela literatura consultada. A boa taxa de prenhes apresentada na IATF deveu-se ao bom controle hormonal do ciclo estral e da qualidade do sêmen utilizado. A taxa de prenhez dos animais que foram submetidos à monta natural foi baixa pelo fato de que os reprodutores não conseguiram cobrir todas as fêmeas. ABSTRACT The artificial insemination (AI) is the most used biotechnology with superior advantages in relation to the use of natural mounting, whose effectiveness is given in the large scale of reproduction among cattle. Associating this biotechnique with hormones it is possible to establish manipulations of the reproductive system of the female, leading to managements of numerous heads of cattle to inseminate at a fixed time. Therefore, 5 IATF protocols were performed, having 2 categories of animals: nulliparous and multiparous. In protocol 1, 81 multiparous animals were submitted, resulting in 47 pregnant animals; in protocol 2, 103 multiparous animals were submitted, resulting in 51 pregnancies; and in protocol 5, 77 multiparous animals were submitted, resulting in 36 pregnant animals. Each service performed was mathematically calculated, with the starting point being the body score, animal welfare and the well exercised technique. Thus obtained good results in the (IATF), which highlights the percentage: protocol 1 obtained 58.02%, protocol 2 obtained 49.51% in pregnancy rate, in protocol 3 obtained 55.67% in pregnancy rate, protocol 4 obtained 53.33% pregnant, and protocol 5 resulted in 46.75% pregnant. The use of the reproduction biotechnologies, performed in beef cattle, obtained results within the described by the consulted literature. The good pregnancy rate presented in the IATF was due to the good hormonal control of the estrous cycle and the quality of the semen used. The pregnancy rate of animals that were subjected to natural mating was low due to the fact that the sires could not cover all the females. Keywords: Hormones. Cattle Pregnancy Rate. One of the strands of the Transhumanist movement, Singulitarianism, studies the possibility that high-level artificial intelligence may be created in the future, debating ways to ensure that the interaction between human society and advanced artificial intelligence can occur safely and beneficially. But how can we guarantee this safe interaction? Are there any indications that a Singularity may be on the horizon? In trying to answer these questions, We'll make a small introduction to the area of security research in artificial intelligence. (...) We'll review some of the current paradigms in the development of autonomous intelligent systems and evidence that we can use to prospect the coming of a possible technological Singularity. Finally, we will present a reflection using the COVID-19 pandemic, something that showed that our biggest problem in managing existential risks is our lack of coordination skills as a global society. Internodons are a formalization of Hennig's concept of species. We present an alternative construction of internodons imposing a tree structure on the genealogical network. We prove that the segments (trivial unary trees) from this tree structure are precisely the internodons. We obtain the following spin-offs. First, the generated tree turns out to be an organismal tree of life. Second, this organismal tree is homeomorphic to the phylogenetic Hennigian species tree of life, implying the discovery of a multi-level tree of life: (...) this phylogenetic tree can be obtained by zooming out from the organismal tree, or conversely, the organismal tree of life can be generated by expanding the phylogenetic nodes into unary trees. Finally, the definition of the organismal tree allows an efficient algorithmic transformation of a given genealogical network into its corresponding phylogenetic species tree of life. Ever since Tulving’s influential 1985 article “Memory and Consciousness” it has become traditional to think of autonoetic consciousness as necessary for episodic memory. This paper questions this claim. Specifically, it argues that the construct of autonoetic consciousness lacks validity and that, even if it was valid, it would still not be necessary for episodic memory. The paper ends with a proposal to go back to a functional/computational characterization of episodic memory in which its characteristic phenomenology is a contingent feature of (...) the retrieval process and, as a result, open to empirical scrutiny. The proposal also dovetails with recent taxonomies of memory that are independent of conscious awareness and suggests strategies to evaluate within- and between-individual variability in the conscious experience of episodic memories in human and non-human agents. Este ensaio celebra as cinco décadas da publicação do livro A ordem do discurso de Michel Foucault, realizando uma reflexão acerca de sua repercussão entre as ciências sociais e sobre seus usos, principalmente, no campo da linguagem na parte relacionada à análise do discurso de linha francesa. Portanto, trata-se de uma retrospectiva crítica cuja análise começa com a entrevista que Foucault concedeu algumas semanas antes de proferir esta aula aos brasileiros Sergio Paulo Rouanet e José Guilherme Merquior. Em seguida, o (...) presente trabalho faz uma breve história da entrada de Foucault ao Collège de France e, por fim, lida com a microfísica do discurso que se encontra nesta aula, sobretudo, da rarefação do sujeito, além dos seus usos nas ciências humanas e sociais mais o campo da linguagem em torno da pragmática e das análises de discurso. O presente estudo, fruto de inquietação surgida em aulas de Filosofia no curso de mestrado em Direito pela Pontifícia Universidade Católica de São Paulo (PUC-SP), investiga a concepção filosófica da liberdade humana e o impacto da pena de prisão, visando à compreensão da eficácia da ressocialização. Com esta pesquisa, busca-se verificar como ocorre a privação de liberdade no Brasil para que se possa compreender de que forma o sistema de Justiça brasileiro persegue a almejada ressocialização prevista no art. 1º da (...) Lei nº 7.210/1984 (Lei de Execução Penal). Utilizando metodologia de levantamento bibliográfico, aborda-se inicialmente a perspectiva de renomados filósofos sobre a liberdade. Em seguida, traça-se uma análise histórica das origens das prisões e sua evolução como forma de punição estatal. O artigo também examina a realidade contemporânea do sistema carcerário, destacando violações de Direitos Humanos e dados estatísticos relevantes, além de considerar decisões da Suprema Corte brasileira. Conclui-se que a restrição da liberdade pode não ser o caminho para se atingir a ressocialização de pessoas que não utilizaram bem sua liberdade e, como consequência, cometeram crimes. Com isso, não se quer defender o fim da pena privativa de liberdade, mas reservar essa intervenção aos casos estritamente necessários. Diante do atual cenário de encarceramento em massa e do Estado de Coisas Inconstitucional do sistema carcerário, o Estado brasileiro não proporciona efetivavas condições à ressocialização dos detentos. Este estudo contribui para a discussão crítica da política de encarceramento a fim de contribuir com soluções para os desafios enfrentados pelo sistema prisional. (shrink)

In 2017, the neologism “Aporophobia”, developed by the Spanish philosopher Adela Cortina, professor of Moral Philosophy at the University of Valencia, was elected as the word of the year. Such a concept was developed by Cortina in order to highlight what she calls a systemic rejection towards poverty and people without resources. Our goal in this paper is to explain the concept of aporophobia and the argumentative premises used by the philosopher to validate it, as well as to use contemporary (...) authors to reflect on the ways in which we can visualize and think such condition in our societies and contemporaneity. How can someone reconcile the desire to eat meat, and a tendency toward vegetarian ideals? How should we reconcile contradictory moral values? How can we aggregate different moral theories? How individual preferences can be fairly aggregated to represent a will, norm, or social decision? Conflict resolution and preference aggregation are tasks that intrigue philosophers, economists, sociologists, decision theorists, and many other scholars, being a rich interdisciplinary area for research. When trying to solve questions about moral uncertainty a meta understanding of (...) the concept of normativity can help us to develop strategies to deal with norms themselves. 2nd-order normativity, or norms about norms, is a hierarchical way to think about how to combine many different normative structures and preferences into a single coherent decision. That is what metanormativity is all about, a way to answer: what should we do when we don’t know what to do? In this study, we will review a decision-making strategy dealing with moral uncertainty, Maximization of Expected Choice-Worthiness. This strategy, proposed by William MacAskill, allows for the aggregation and inter-theoretical comparison of different normative structures, cardinal theories, and ordinal theories. In this study, we will exemplify the metanormative methods proposed by MacAskill, using has an example, a series of vegetarian dilemmas. Given the similarity to this metanormative strategy to expected utility theory, we will also show that it is possible to integrate both models to address decision-making problems in situations of empirical and moral uncertainty. We believe that this kind of ethical-mathematical formalism can be useful to help develop strategies to better aggregate moral preferences and solve conflicts. (shrink)

In the Nicomachean Ethics, Aristotle makes the following claims: “the end cannot be a subject of deliberation, but only what contributes to the ends” (NE 1112b33-34) and “virtue makes the goal right, practical wisdom makes the things to- ward the goal right" (NE 1144a7-9). A problem arises from such claims: the ends as- sumed by a moral agent cannot be subject to rational choice. For deliberation, an intel- lectual procedure, is bound to deal with the things that contribute to the (...) ends, and the ends, in turn, fall within the realm of virtue of character, which is described by Aristotle as a virtue of the non-rational part of the soul. In order to understand how Aristotle sup- ports such thesis, this research investigates how virtue of character and practical wis- dom are related and their work to delimit the ends and the things that contribute to the ends in the moral actions. In this paper, I put under scrutiny the arguments put forward by Aristotle in Nicomachean Ethics (NE) VI.9. The paper has two main parts. In the first, I examine the NE VI.9’s first part where Aristotle develops the concept of good deliberation, offering its definition in 1142b27-28. In the second, I examine the connection between good deliberation and phronesis, and, then, I discuss the vexata quæstio about if the lines 1142b31-33 might be read as introducing the claim that phronesis provides (...) moral ends.
